The Uniform Commercial Code 4AA (UCC4A) plays a significant role in the ACH Network. Financial institutions need to understand the complexities of the UCC4A, how it applies to transactions, and how liability for transactions is allocated.
Attendees will learn when UCC-4A applies, what protections the law provides and what responsibilities are given to the parties of a UCC-4A funds transfer. We will discuss commercially reasonable security procedures and how to allocate payment fraud risk by contract.
At the conclusion of this advanced session, learners will be able to:
• Interpret commercially reasonable security practices
• Identify key components of UCC4A impacting ACH Transactions such as the enforceability of payment orders, liability shifts, and more
• Record procedures for unauthorized entries and security procedures
