Third-Party Service Providers, including Third-Party Senders are required to abide by the Nacha Operating Rules. As an ODFI, you are ultimately responsible for the compliance of ACH Entries originated using your routing number – even if a Third-Party Service Provider is used to create and/or transmit the Entry. And as an RDFI, if you’re using a Third-Party Service Provider to assist in your processing of received Entries, you, as the financial institution, are ultimately responsible for ACH Rules compliance. • Assess their financial institution’s policies, procedures, and processes to determine that the FI has adequate oversight of their ACH Third-Party Service Providers’ compliance with the Rules, including the requirement for the participating DFI to obtain proof of the completion of the TPSP’s ACH compliance audit.
• Formulate a plan to work with their institution’s Third-Party Risk Management to implement improvements to oversight (if needed).
• Devise a method to disseminate their newfound knowledge to colleagues who could benefit from the information.
