Negotiating checks as a depository institution poses significant risks related to loss and returns. While the institution may want to opt to hold everything to protect itself, there are considerations that must be accounted for. Checks are subject to the funds availability requirements addressed in Regulation CC which enacted the Expedited Funded Availability Act of 1987. Financial Institutions are required to understand and properly implement the requirements of Regulation CC. Failing to follow these practices can result in potential consequences such as those related to examination and consumer protection requirements. In this session, we explore funds availability as it relates to the requirements outlined in Regulation CC Subpart B. This regulation dives into the requirements for institutions to make certain types of instruments and dollar amounts available to the depositor. Specific topics addressed include next-day availability, availability schedule, exceptions, payment of interest, disclosure requirements, availability policy, and civil liability. This session will also explain which items and situations are exempt from Reg CC requirements.
