Payments are governed by a combination of Federal and state laws in conjunction with rule frameworks. It is important for those handling payment functions to have a solid understanding of what these legal frameworks are and how they impact your obligations in a financial institution. Knowing these requirements enables professionals to be able to help with the creation of solid business decisions such as those related to service offerings, policy, process, and procedure. In this session, we explore Uniform Commercial Code (UCC) governance, specifically examining the requirements under UCC 3, UCC 4, and UCC 4A.

• In UCC 3 we cover negotiable instruments (checks) and will explore topics such as the definition of a negotiable instrument and what makes it qualify as a payment mechanism. Topics surrounding negotiation, transfer, and indorsement will be addressed along with enforcement, liability, dishonoring of items, and discharge of payment.

• In UCC 4 we will cover bank deposits and collections and will explore topics such as item collection (including warranties) and the role of depositing and paying institutions.

• In UCC 4A we cover funds transfers (ACH and Wires) and explore topics such as security procedures, erroneous payment, and sender, receiver, and bank obligations.

Having a good understanding of how UCC applies to payments is paramount for acting compliantly in the payment space. Come join us for this session where we explore the implications of UCC for payment processing.
